The relator presented an affidavit and petition in which he sought to invoke the original jurisdiction of this court and to have us issue an alternative writ of mandamus to compel the Secretary of State and the County Auditor of Cass County to print and deliver to qualified electors absent voters ballots containing the names of candidates for election to the office of United States Senator to fill the vacancy created by the death of the late Honorable John Moses. The petition was accompanied by a refusal of the Attorney General to bring the action in the name of the State of North Dakota. We issued an order to show cause why a peremptory writ of mandamus should not issue returnable on April 29, 1946. On the return date the Attorney General of the State of North Dakota, representing the respondents, appeared and moved to quash the petition and the matter was heard on the issues thus framed. On January 12, 1946, the Governor of North Dakota issued a writ of election directed to the Secretary of State which recited the circumstances creating a vacancy in the office of the United States Senator from the State of North Dakota, for the term ending in January, 1951, and further stated:
